Terms & Conditions
These Terms govern your use of the Herae browser extension and the Herae Moments website (together, the "Service"). By creating an account or using Herae, you agree to them. If you don't agree, please don't use the Service.
1. Who can use Herae
You must be at least 13 years old (or the minimum digital-consent age in your country, if higher) to use Herae. You're responsible for keeping your login credentials secure and for activity on your account.
2. Your account
- Provide accurate information when you sign up and keep it current.
- One person per account; don't impersonate others or use a username you have no right to.
- You can invalidate all active sessions at any time by resetting your password, and delete your account entirely at any time (see the Account Deletion Policy).
3. What Herae does — and doesn't
Herae synchronizes playback of video that already exists on third-party websites and adds voice, video, and chat between participants. Herae does not host, stream, rebroadcast, or provide any of that third-party video content. You are responsible for ensuring you have the right to view content on the sites you use Herae with, and for complying with those sites' own terms.
4. Your content
You keep ownership of the Moments, reviews, comments, and other content you create ("Your Content"). By posting it, you grant Herae a limited, non-exclusive license to store, process, and display it solely to operate the Service for you and the people you share it with, according to the privacy level you choose. This license ends when you delete the content or your account, except for copies we're legally required to retain or that others have already downloaded or re-shared.
You are responsible for Your Content and confirm you have the rights to share it. Don't upload content that infringes others' rights or violates our Community Guidelines.
5. Acceptable use
You agree not to:
- Break the law, infringe intellectual property, or violate others' privacy.
- Harass, threaten, or abuse other people, or share non-consensual, sexual-exploitation, or hateful content (see Community Guidelines).
- Attempt to breach, overload, reverse-engineer, or circumvent the security, rate limits, or access controls of the Service.
- Use the Service to distribute malware, spam, or automated abuse.
- Use another person's account or capture recordings of others without their knowledge in a way that violates applicable law.
6. Moderation & enforcement
We may remove content or suspend or terminate accounts that violate these Terms or our policies, especially to protect people from harm. Where practical and lawful, we'll aim to tell you why.
7. Third-party services
Herae works alongside third-party websites and, through the Share feature, lets you post to platforms like Instagram, Facebook, WhatsApp, and Telegram. Those services have their own terms and privacy policies, and we're not responsible for them.
8. Availability, paid plans, programs & changes
Herae is offered on an "as is" and "as available" basis, and is in active development. We may change, suspend or discontinue features, plans or the whole Service. We'll try to give reasonable notice of significant changes.
Paid plans. Paid plans and gifts are sold by our reseller and Merchant of Record, Paddle, whose buyer terms also apply to your purchase. Cancellation and refunds are covered by our Refund Policy. If we discontinue the Service entirely, paid plans end with it, and refunds are given where the law requires them.
Programs. Invite rewards, gifts, free plans we grant (including free-for-life) and the Creator & Affiliate Program are governed by our Program Terms, which also explain what happens if a program or Herae ends.
9. Disclaimers
To the fullest extent permitted by law, Herae disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the fullest extent permitted by law, Herae and its operators, owners and team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits, revenue, opportunities or goodwill, arising from or related to the Service. Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US$50.
Nothing in these Terms limits liability that can't be limited by law (for example, for fraud, or for death or personal injury caused by negligence), or removes rights you have as a consumer under the law of the country where you live.
11. Indemnity
You agree to indemnify and hold Herae and its operators harmless from claims arising out of Your Content or your misuse of the Service or violation of these Terms.
12. Termination
You may stop using Herae and delete your account at any time. We may suspend or terminate access for violations of these Terms. Provisions that by their nature should survive termination (e.g. content license limits, disclaimers, limitation of liability) will survive.
13. Governing law & changes to these Terms
These Terms are governed by the laws of the jurisdiction in which Herae is operated, without regard to conflict-of-laws rules. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live. Before starting any formal dispute, please email legal@herae.app so we can try to resolve it within 30 days. If any part of these Terms can't be enforced, the rest still applies. We may update these Terms; material changes will be reflected in the "Last updated" date and, where appropriate, announced in-app.
